Popup Audio (“Popup Audio”, “the App”, “we”, “us” or “our”) is dedicated to protecting the privacy of Personal Information it holds about individuals. “Personal Information” is any information or opinion, whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent or can be reasonably ascertained from the information or opinion.

1) How we collect your personal Information We collect Personal Information in a number of ways, as set out below: a) from you personally when you provide Personal information to us, for example if you provide us with your contact details at one of our events or promotions; b) if you sign up to our newsletter or otherwise register your details with us; c) from publicly available sources of information; d) if you visit our website, answer a survey we are conducting or enter one of our competitions;

2) What Personal Information we collect We may collect your: a) name, email address, address, date of birth, mobile phone number and postcode; b) any further information about you that you provide to us, for example at our events or promotions, answering surveys or competitions;

3) How we may use your Personal Information We would only use your Personal Information for purposes necessary for one or more of our functions or activities. For any further purposes we would seek your express consent. We may use

our Personal Information to: a) provide you with available Popup Audio goods or services that you request; b) send you content from us, or on behalf of our clients, via email or SMS from Popup Audio; c) include your photo on the Popup Audio Website, Facebook or Instagram page; d) market and promote Popup Audio future goods, events and services to you (including via email, SMS,MMS and direct mail) and keep you informed of updates, special offers and further information around Popup Audio; e) research and develop our services;

4) Who we may disclose your Personal Information

To help us provide or improve our services, we may need to disclose your Personal Information to the following limited organisations: a) Popup Audio clients for their marketing and promotional activities, where you have attended or otherwise taken part in a Popup Audio event or promotion for their company or brand; b) service providers and third party consultants and contractors who provide services to us: (i) mailing operations and printing; (ii) advertising agencies; (iii) service providers who assist us in operating our website and other information technology services; (iv) marketing and/or market research; (v) website use analysis; and (vi) professional legal and accounting services; and c) individuals, corporations, organisations and government and regulatory authorities, as required or authorised by law. Otherwise if we are disclosing your Personal Information to third parties not listed here, this will be because we are under the reasonable belief that you authorised us to do so; or your safety, or the safety of others is at risk. If we disclose Personal Information to a third party, we take reasonable steps to ensure that this third party is bound by privacy obligations consistent with the Privacy Act 1988 (Cth) and other relevant laws in relation to holding and protecting your Personal Information.

5) What if you don’t provide the Personal Information?

If you are unable to provide us with Personal Information, we may not be unable to provide you with information or particular services you

require.

and how to access your Personal Information

Please be assured that we take reasonable steps to ensure Personal Information we hold about you is accurate, complete and up-to-date. Please inform us if there are any mistakes in the information we have about you, or if your details change. You can request correction of Personal Information which we hold about you by contacting info@popupaudio.com.au You have the right (subject to certain exemptions under law) to access Personal Information that we hold about you. Please contact us on info@popupaudio.com.au if you would like to request details of Personal Information that we hold about you. We do have the rightto charge a reasonable fee for preparation and provision of this

Personal Information to you. We may in certain circumstances deny access, and in this circumstance we will notify you.

7) Security

Please be assured that we will take reasonable steps to make sure that Personal Information we hold about you is protected from risks

such as unauthorised access, loss, use, modification or disclosure.

8) Use of Microphone and Camera on device

Popup Audio may ask to have access to your device microphone and camera. By not allowing access to these services the app

functionality may be compromised.

9) Information Collected via the App

Depending on your device, our App may request certain permissions that allow it to access your device data. By default, you must grant these permissions before the respective information can be accessed. Once the permission has been given, you can revoke it at any time and it is your responsibility to monitor/adjust them in accordance with your preferences. In order to revoke these permissions, you may refer to the device settings. The exact procedure for controlling app permissions may be dependent on your device and software. Please note that the revoking of such permissions might impact the proper functioning of the App. If you grant any of the permissions listed below, your information may be collected by the App:

• Camera: Only required in HOST mode. This permission is needed to allow the App to use your camera when taking pictures while

creating an event within the App. The App will simply open your camera roll to use an existing image or allow you to take a photo to

be used as the event image. Once you have signed out of the App, there are no functions used to access your camera.

• Microphone: Only required in HOST mode. Almost identical to the camera permission, the microphone permission is requested so that

the App can transmit audio during a Popup Audio event . Your microphone cannot be accessed once you have signed out of the

App. Audio is not recorded or stored by the App.

10. Children’s Privacy

Popup Audio app events are not directed to children under the age of 16 without adult supervision, and we do not knowingly collect Personal Information from children under the age of 16 without obtaining parental consent. If we learn that Personal Information has been collected via any sign up from persons under 16 years of age and without verifiable parental consent, then we will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child under 16 years of age has provided Personal Information, then you may alert us by email on info@popupaudio.com.au and request that we delete that child’s Personal Information from our systems.

11. Unsubscribe

If you no longer wish to us to contact you to market and promote products, services and special offers to you, you may unsubscribe via the unsubscribe facility that we send you in emails or SMS, alternatively you can email hello@popupaudio.com.au to unsubscribe.

12. Cookies

On visiting our website, our servers may record details such as the URL and date and time of your attempt to visit our website. It assists us to improve our website and review its performance. We may use “cookie technology” where our servers deposit small text files on a visitor’s computer. It assists us in determining your preferences, improves your experience, calculates the number of visitors to our website and the internet browsers used and other operating systems. The cookies may also collect and store Personal Information in relation to you. This information would be treated in the same way as other Personal Information about you, as set out in this document. Generally you can adjust your web browser to disable or delete cookies, or warn you when cookies are being used. However, if you disable cookies, you might not be able to access certain areas of our website, or experience certain features on the website.
